    The Terms and Conditions of Service Agreement (the "Agreement") or (“Our Terms”) governs your use of this website and service, [www.EarleyOsteopathy.co.uk] (the "Website"), [Earley Osteopathy] ("Business Name") constitute a legally binding agreement between you and Earley Osteopathy (“Earley Osteopathy”, “we”, “us” or “our”). Earley Osteopathy is a privately owned/run Mobile Osteopathy Service based in Stanmore, London.

    This Agreement includes, and incorporates by this reference, the policies and guidelines referenced below.

    Earley Osteopathy reserves the right to change or revise the terms and conditions of this Agreement at any time by posting any changes or a revised Agreement on this Website.

    Earley Osteopathy will alert you that changes or revisions have been made by indicating on the top of this Agreement the date it was last revised. The changed or revised Agreement will be effective immediately after it is posted on this Website.

    Our Terms govern your use of the Website following the posting of any such changes or of a revised Agreement will constitute your acceptance of any such changes or revisions. Earley Osteopathy encourages you to review this Agreement whenever you visit the Website to make sure that you understand the terms and conditions governing use of the Website and service.

    If you do not agree/accept Our Terms (including any referenced policies or guidelines), you must not make an appointment through Earley Osteopathy and please immediately terminate your use of the Website.

    PERSONAL DATA

    Before making an appointment please read our privacy notice. While using our website or providing this service we may ask you to provide us with certain personally identifiable information.

    CONSUMER TERMS

    The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 require Earley Osteopathy to give you certain key information for there to be a legally binding contract between you and us.

    ELIGIBLE USE

    You confirm that you are of legal age to access and use Our Site or the Service and are of legal capacity to agree to Our Terms. You are not eligible to use the Services if you are under the age of 18. Our Terms apply to individuals only

    AGREEMENTS FOR OSTEOPATHY

    When making an appointment via Earley Osteopathy you will be provided with and asked to confirm your acceptance of our terms. The Service you receive will be subject to Earley Osteopathy’s terms and conditions.

    SERVICE AREA

    It is your responsibility, during the booking process, to check the service area map and the listed areas within as to establish your location to the available service area(s). Any appointment(s) located outside the service area will not be accepted and refunds may incur an administration fee.

    APPOINTMENTS

    Appointments can be made through Our Site and only up to two months in advance. Your payment details will be requested at the time of booking any appointment and payment will be collected when you make a booking. Full payment of the Consultation/Treatment Fees is due at the time of booking.

    You are responsible for, when making a booking:

    Full payment of the Treatment Fee;

    Ensuring there is adequate access to your designated location without obstructions, which must, in all cases, represent a suitable clean space in which the treatment (Osteopathy) can be performed, with all appropriate facilities (including adequate lighting, heating, toilet and wash); and ensuring the health and safety of the practitioner whilst at your designated location.

    PAYMENT

    All Osteopathy Treatment Fees are payable through Our Site. Earley Osteopathy will do all that we reasonably can to ensure that all of the information you give us when paying for Osteopathy is secure by using an encrypted secure payment mechanism/system. However, in the absence of negligence on the part of Earley Osteopathy, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorized access to any information that you may give us at any time.

    All payments by credit card or debit card need to be authorized by the relevant card issuer. We may also need to use extra security steps via Verified by Visa where applicable.

    By making a booking you agree to provide complete, correct and true information including without limitation billing and payment information.

    TREATMENT PRICES

    The price of Osteopathy (“Treatment Price(s)”) varies according to the type, duration and time slot you book.

    Treatment Prices are set from time to time and are subject to change at any time but will not affect any bookings already previously made

    The Treatment Price(s) you will be required to pay for will be determined by reference to the Treatment Prices in force at the date when Osteopathy is booked.

    YOUR RESPONSIBILITIES

    In addition to the responsibilities noted above, you are responsible for providing complete and accurate information at the time of booking. Rejection and or cancellation of an appointment request(s) may result if failure to provide complete and accurate information. Ineligibility of payment refunds may result

    In such cases where there has been a failure on your part to provide us with accurate information, our cancellation and refund policy will apply.

    CANCELLATIONS AND REFUNDS

    By making an appointment with Earley Osteopathy you agree that you do not have any statutory right to cancel the booking made but rather you have a contractual entitlement to cancel the booking made.

    The implementation of Our Cancellation charges are to compensate Earley Osteopathy in recognition of loss, due to unreasonable and unrealistic expectation of providing another booking with our service due to your late (short) or very late or no notice of cancellation. Earley Osteopathy will have full and absolute discretion to decide whether to waive the cancellation fee when genuine reasons were outside of your control that lead to you incurring a cancellation fee.

    TERMS:- Cancellation/Refunds

    Cancellations of a booked appointment of at least (24) Twenty-Four hours or more before the booked appointment time and or within (10) Ten Minutes of confirming/booking your appointment if it occurs within the (24) twenty-four hour period - Earley Osteopathy will not require payment for all or part of the appointment booked and a 100% refund will issued

    Late Cancellations of a booked appointment that are within the (24) Twenty-Four hour period or after the (10) Ten Minutes of confirming/booking your appointment and more than (3) Three hours before the booked appointment time - Earley Osteopathy will be entitled to charge/retain 40% of the Appointment Fee

    Very Late Cancellations of a booked appointment that are within (2) hours of the booked appointment time and after the (10) Ten Minutes of confirming/booking your appointment - Earley Osteopathy will be entitled charge/retain 100% of the Appointment Fee.

    Cancellation charges also apply

    When attempting to cancel a booking on or after the appointment time

    When failing to attend an appointment at the booked time and or at the designated location.

    When failing to provide all accurate and complete contact details or personal information such as but not limited to full name, phone number and address.

    When failing to provide accurate designated location information.

    APPOINTMENT DELAYS

    If by more than 10 minutes you are delayed or unable to start the booked appointment at the booked appointment time and at the designed location, by sole discretion, Earley Osteopathy is entitled to end the appointment at the time agreed when the appointment was booked without any adjustments to the treatment fee to indicate the decreased time of the appointment or If an agreement between you and Earley Osteopathy to continue with the full appointment time, notwithstanding the delayed start time you will be obliged to pay an additional charge .

    No Unlawful or Prohibited Use

    As a condition of using Our Site, you warrant to us that you will not use Our Site or book an appointment via Earley Osteopathy for

    any purpose that is unlawful or is not permitted, expressly or implicitly, by the terms of this Agreement or by any applicable law or regulation. You further warrant and represent that you will not use Our Site in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service.

    You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Service.

    You agree that these warranties and representations will remain in full force and effect even if this Agreement terminates for any reason.

    We reserve the right, to terminate your account and your right to use Our site or service at any time and for any reason, including without limitation if we, in our sole judgment, believe you have engaged in conduct or activities that violate any of the Terms or the rights of Earley Osteopathy, or if you provide us with false or misleading information or interfere with other users or the administration of the Services.

    We reserve the right, to terminate if you engage in any inappropriate behaviour including but not limited to illicit or sexually suggestive remarks, sexual advances, drug use, excessive drinking and/or other inappropriate behaviour;

    You may not Infringe the privacy rights, property rights, or other civil rights of any person;

    You will not harass, abuse, threaten or otherwise infringe or violate the rights of Earley Osteopathy Osteopath’s

    Introduce or attempt to introduce any viruses or any other harmful code, files or programs that interrupt or otherwise or limit the Services, Our Site functionality, or damage, disable or otherwise impair our servers or networks or attempt to do the same; or

    Engage in or encourage others to engage in criminal or unlawful conduct or breach Our Terms including misuse of the Services for unlawful or unauthorised purposes.

    Once your account has terminated for any reason, you will have no further right or access to use the Service.

    You agree not to breach Our Terms in any way which may result in, among other things, termination or suspension of your access to the Services. We reserve the right to disclose information of suspicious behaviour related but not limited to any of the listed above to law enforcement.

    INTELLECTUAL PROPERTY

    The service and its original contents, features and functionality are and will remain the exclusive property of Earley Osteopathy and its Licensors. The Earley Osteopathy Logo, Brand and other Intellectual Property rights includes, but is not limited to, trademarks, trade names, service marks, service names, copyrights, licences belong to us They are protected by intellectual property law.

    SEVERABILITY

    If any provision in these terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objective of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect

    TERMINATION OF USE

    Earley Osteopathy may, in its sole discretion, modify these terms and conditions or terminate/ suspend all or part of the Website, for any reason, including without limitation, breach of these Terms and Conditions. In the event this agreement is terminated, the restrictions regarding materials appearing on the site and the representations and warranties, indemnities, and limitation of liabilities set forth in this agreement shall survive any such termination.

    GOVERNING LAW AND JURISDICTION

    This agreement shall be governed by and construed in accordance with the laws of England, English courts only shall have jurisdiction over any dispute arising out of or relating to this agreement, and each party hereby consents to the jurisdiction and venue of such courts.

    1 - Your Practice - Earley Osteopathy, Stanmore, London HA7 3BS, which hereafter for the purposes of this Privacy Notice will be referred to as the Osteopaths, is pleased to provide the following information:

    2 - Who We Are - The Osteopaths diagnose and treat health conditions. Treatments are carried out in accordance with the Institute of Osteopathy’s patient charter http://www.iosteopathy.org/osteopathy/the-patient-charter/. The practice may also provide other treatments, about which our staff will be pleased to provide more details.

    3 - Personal Data - (A) For the purposes of providing treatment, Osteopaths may require detailed medical information. We will only collect what is relevant and necessary for your treatment. When you visit our practice or I visit you, we will make notes which may include details concerning your medication, treatment and other issues affecting your health. This data is always held securely, is not shared with anyone not involved in your treatment, although for data storage purposes it may be handled by pre-vetted staff who have all signed an integrity and confidentiality agreement. To be able to process your personal data it is a condition of any treatment that you give your explicit consent to allow Osteopaths to document and process your personal medical data. Contact details provided by you such as telephone numbers, email addresses, postal addresses may be used to remind you of future appointments and provide reports or other information concerning your treatment. As part of our obligations as primary healthcare practitioners there may be circumstances related to your treatment, on-going care or medical diagnosis that will require the sharing of your medical records with other healthcare practitioners e.g GPs, consultants, surgeons and/or medical insurance companies. Where this is required we will always inform you first unless we are under a legal obligation to comply. (B) For marketing purposes, the Osteopaths may also use the contact details provided by you to respond to your enquiries, including making telephone contact and emailing information to you which the practice believes may be of interest to you. (C) In making initial contact with the practice you consent to Osteopaths maintaining a marketing dialogue with you until you either opt out (which you can do at any time) or we decide to desist in promoting our services. Osteopaths may occasionally also act on behalf of its patients in the capacity of data processor, when we may promote other practitioners based at our premises, who may not be employed by us. Osteopaths do not broker your data and you can ask to be removed from our marketing database by emailing or phoning the practice using the contact details provided at the end of this Privacy Notice. (D) Some basic personal data may be collected about you from the marketing forms and surveys you complete, from records of our correspondence and phone calls and details of your visits to our website, including but not limited to, personally identifying information like Internet Protocol (IP) addresses. (E) Osteopaths’ website uses cookies, which is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. WordPress.org uses cookies to help Osteopaths to identify and track visitors and their website access preferences. (F) Osteopaths will only collect the information needed so that we can provide you with the services you require, the business does not sell or broker your data.

    4 - Legal basis for processing any personal data - To meet our contractual obligations obtained from explicit Patient Consent and legitimate interest to respond to enquiries concerning the services provided.

    5 - Legitimate interests pursued by Osteopaths - To promote treatments for patients with all types of health problems indicated for osteopathic care.

    6 – Consent - Through agreeing to this privacy notice you are consenting to Osteopaths processing your personal data for the purposes outlined. You can withdraw consent at any time by using the postal, email address or telephone number provided at the end of this Privacy Notice.

    7 – Disclosure - Osteopaths will keep your personal information safe and secure, only staff engaged in providing your treatment will have access to your patient records, although our administration team will have access to your contact details so that they can make appointments and manage your account. Osteopaths will not disclose your Personal Information unless compelled to, in order to meet legal obligations, regulations or valid governmental requests. The practice may also enforce its Terms and Conditions, including investigating potential violations of its Terms and Conditions to detect, prevent or mitigate fraud or security or technical issues; or to protect against imminent harm to the rights, property or safety of its staff.

    8 - Retention Policy - Osteopaths will process personal data during the duration of any treatment and will continue to store only the personal data needed for eight years after the contract has expired to meet any legal obligations. After eight years all personal data will be deleted, unless basic information needs to be retained by us to meet our future obligations to you, such as erasure details. Records concerning minors who have received treatment will be retained until the child has reached the age of 25.

    9 - Data storage - All Data is held in the United Kingdom. Earley Osteopathy does not store personal data outside the EEA.

    Patient records are stored in a locked filling system which is not accessible by any third party.

    10 - Your rights as a data subject - At any point whilst Osteopaths are in possession of, or processing your personal data, all data subjects have the following rights:

    Right of access – you have the right to request a copy of the information that we hold about you. Right of rectification – you have a right to correct data that we hold about you that is inaccurate or incomplete. Right to be forgotten – in certain circumstances you can ask for the data we hold about you to be erased from our records. Right to restriction of processing – where certain conditions apply you have a right to restrict the processing. Right of portability – you have the right to have the data we hold about you transferred to another organisation. Right to object – you have the right to object to certain types of processing such as direct marketing. Right to object to automated processing, including profiling – you also have the right not to be subject to the legal effects of automated processing or profiling.

    In the event that Osteopaths refuses your request under rights of access, we will provide you with a reason as to why, which you have the right to legally challenge. At your request Osteopaths can confirm what information it holds about you and how it is processed.

    11 - You can request the following information: - Identity and the contact details of the person or organisation (Osteopaths) that has determined how and why to process your data.

    Contact details of the data protection officer, where applicable. The purpose of the processing as well as the legal basis for processing. If the processing is based on the legitimate interests of Osteopaths and information about these interests. The categories of personal data collected, stored and processed. Recipient(s) or categories of recipients that the data is/will be disclosed to. How long the data will be stored. Details of your rights to correct, erasure, restrict or object to such processing. Information about your right to withdraw consent at any time. How to lodge a complaint with the supervisory authority (ICO). Whether the provision of personal data is a statutory or contractual requirement, or a requirement necessary to enter into a contract, as well as whether you are obliged to provide the personal data and the possible consequences of failing to provide such data. The source of personal data if it wasn’t collected directly from you. Any details and information of automated decision making, such as profiling, and any meaningful information about the logic involved, as well as the significance and expected consequences of such processing.

    12 - To access what personal data is held, identification will be required - Osteopaths will accept the following forms of identification (ID) when information on your personal data is requested: a copy of your driving licence, passport, birth certificate and a utility bill not older than three months. A minimum of one piece of photographic ID listed above and a supporting document is required. If Osteopaths is dissatisfied with the quality, further information may be sought before personal data can be released.     13 - Complaints - In the event that you wish to make a complaint about how your personal data is being processed by Osteopaths you have the right to complain to us. If you do not get a response within 30 days, you can complain to the ICO.
